Step 4:
Get ready to fill out your Form 40S


Do I need to fill out my federal (IRS) tax return before I can fill out my Oregon Form 40S?

You may need some information from your federal tax return to fill out your Oregon Form 40S. To figure out if you first need to fill out a federal tax return:

  1. Add the amounts in box 1 from all of your Form W-2s.
    • If that total is $4,850 or less, go to #2 below.
    • If that total is more than $4,850, you need to fill out a federal tax return before you can move on to your Oregon Form 40S.
  2. Add the amounts in box 1 from all of your Form 1099-INTs.
    • If that total is $800 or less, go to #3 below.
    • If that total is more than $800, you need to fill out a federal tax return before you can move on to your Oregon Form 40S.
  3. Add the amounts in box 1 from all of your W-2s and 1099-INTs together.
    • If this amount is $4,850 or less, you can fill out your Oregon Form 40S now before you complete your federal tax return.
    • If this amount is more than $4,850, you need to fill out a federal tax return before you can move on to your Oregon Form 40S.
